Attachment of Earnings

A process whereby the Court of King’s Bench orders that the wages of a person may be diverted to satisfy a court judgment that has been given against that person. The order for attachment of earnings has to be applied for by the party in whose favour the judgment was given. For example, if John has a court order to state that Bill must pay him $5,000 and Bill does not pay within the given time, John can apply for another court order that a portion of Bill’s salary will be deducted by Bill’s employer, and paid to John until the debt is paid off.
