When a notice of rent increase does not include all of the necessary information, the notice is void and the tenant doesn’t have to pay the increased rent. Notice of rent increases must contain the following:
- amount of rent increase
- date the rent increase will start
- notice must have a date
- the landlord must sign in
If a tenant pays the increased rent, but the notice did not contain all of the necessary information, they can make an application in Alberta Court of Justice Civil or the Residential Tenancy Dispute Resolution Service to get back the amount paid under the increase.
