Fixed-Term Tenancy

If you agreed to rent premises for a fixed length of time you will have a fixed term tenancy.

For example, an agreement to rent from January 1st, 2000 until December 31st, 2000 is a fixed term tenancy.

Even if you are paying a monthly, weekly, or annual rent, it is still a fixed term tenancy until December 31st, 2000 when the tenancy ends automatically. The landlord and tenant can agree that when the fixed term ends, the tenancy can be renewed, but there is no requirement under the Residential Tenancies Act to renew the tenancy.

Characteristics of a fixed term tenancy include :
  • The landlord and tenant do not have to give each other written notice to end the agreement unless a term of the agreement requires written notice;
  • Any changes to the tenancy agreement have to be the subject of a new agreement between the landlord and tenant and should be in writing;
  • If the landlord and tenant decide to renew the tenancy, they can negotiate the rent as part of the new agreement.
  • The tenant is not released automatically from the fixed term if he or she leaves before the end of the tenancy agreement. The landlord can still require the rent to be paid under the terms of the tenancy agreement. The landlord has to try to rent the premises to someone else, but in the meantime the original tenant must still pay the rent.
